Terms of Service

By using TeselaGen's Services, you agree to be bound by these Terms. If you are using our Services on behalf of an organization, you are agreeing to these Terms on behalf of that organization, and you represent that you have authority to do so. TeselaGen may modify or discontinue the Services at any time without notice.

Your Data & Your Privacy

You retain complete ownership of your DNA Sequence Data, DNA Part Data, DNA Design Data, and associated information (“your data”). TeselaGen claims no ownership rights to your data. We only receive limited permissions necessary to operate the Services, including the use of trusted third parties like server providers. Data sharing with law enforcement or others occurs only with your direction, as detailed in our Privacy Policy.

Sharing Your Data

The Services include features allowing you to share data with others or make it public. You bear responsibility for carefully considering what you share. TeselaGen assumes no responsibility for activities involving publicly shared data.

Your Responsibilities

You are solely responsible for:

• Ensuring you possess rights to content you copy, upload, download, or share
• Maintaining and protecting all your data (TeselaGen provides no liability for data loss)
• Keeping account information current and accurate
• Not uploading malicious software
• Complying with intellectual property protections

The Services are not intended for users under 13 years old.

Software and Updates

TeselaGen grants a limited, nonexclusive, nontransferable, revocable license to use downloaded software solely to access the Services. You may not reverse engineer or decompile the Software. Automatic updates may occur when new versions become available. The pause syncing feature pauses data synchronization but may not cease all data transfer.

TeselaGen Property and Feedback

These Terms grant no rights to Services content or intellectual property. Feedback, comments, or suggestions you provide may be used by TeselaGen without obligation. The Software and technology are protected by U.S. and international copyright and trademark laws. You receive no rights to TeselaGen trademarks, logos, domain names, or brand features.

Copyright

TeselaGen respects intellectual property rights and responds to properly provided copyright infringement notices in accordance with applicable law.

Other Content

The Services may contain links to third-party websites. TeselaGen does not endorse or assume responsibility for third-party sites, content, products, or services. Open source license provisions may supersede these Terms where applicable.

Termination

You may discontinue using the Services at any time. TeselaGen reserves the right to suspend or terminate access with or without cause and with or without notice. Reasons may include Terms violations or activities causing legal liability or service disruption. TeselaGen attempts advance notice and data retrieval assistance, though immediate suspension may occur for flagrant violations, court orders, or user safety concerns.

End Users

End users may join with new accounts or convert existing personal accounts. Administrators gain control over account information and access once conversion occurs. End users must comply with employment obligations and customer policies.

Customer Obligations

• Customers must comply with the Terms of Service and Acceptable Use Policy
• Responsible for maintaining administrator password confidentiality
• Must prevent unauthorized use and notify TeselaGen of any breaches
• Cannot resell services or use them for activities risking physical harm
• Responsible for industry-specific regulation compliance (e.g., HIPAA)

Services

TeselaGen uses commercially reasonable security standards for data storage. Customer data may be transferred, processed, and stored globally. TeselaGen may update services; material reductions in functionality require notification.

Support

Customer handles end-user support at their own expense.

Suspension

TeselaGen may suspend accounts for violations or excessive support requests. Security emergencies trigger automatic suspension with narrow tailoring to the affected scope.

Intellectual Property

TeselaGen retains all intellectual property rights in the Services. Customer grants limited permissions necessary to operate the platform. TeselaGen may use customer feedback for product improvements.

Fees & Payment

Fees are non-refundable except within the first 30 days or as required by law. Subscriptions auto-renew and are charged automatically unless the customer cancels before the renewal date.

Limitation of Liability

Neither party shall be liable for lost revenues or indirect, special, incidental, punitive, or consequential damages. TeselaGen and its affiliates, officers, employees, agents, suppliers, and licensors aggregate liability is capped at the greater of $20 or amounts paid in the preceding three months (or $100,000 or amounts paid in the prior 12 months for Commercial Use accounts). State law variations may limit these limitations.

Governing Law

These Terms are governed by California law. Exclusive jurisdiction resides in San Francisco County, California.

Security & System Attacks

• Probing, scanning, or testing system vulnerabilities
• Breaching or circumventing security measures
• Accessing unauthorized areas of the service
• Interfering with networks through viruses, flooding, spamming, or mail-bombing

Malicious Content

• Distributing malware
• Creating DNA sequences intended for harmful purposes

Unauthorized Access

• Accessing services through unsupported means like scraping
• Tampering with computer systems

Deceptive Practices

• Sending unsolicited communications or advertisements
• Spoofing or phishing
• Misrepresenting identity or affiliation
• Publishing fraudulent or misleading content that infringes rights

Legal Violations

Breaking laws, violating privacy, or defaming others is strictly prohibited.

Commercial Use Accounts

TeselaGen provides special Commercial Use Accounts for commercial customers with enterprise software level features not available on Free Accounts. Purchase orders are accepted.

Billing

Fees begin from the registration date and renew monthly or yearly. Invoicing occurs on the corresponding calendar day each period. If the start date doesn't exist in a month, billing occurs on the last day (e.g., a January 31st account would be billed February 28th). All fees and charges are nonrefundable and there are no refunds or credits for partially used periods.

Cancelling Your Account

Accounts remain active until cancelled. You must cancel before the renewal date to avoid charges. TeselaGen does not provide refunds or credits for any partial months or years. Cancellation takes effect immediately via the Account page.

Free Accounts

Free Accounts are available for academic researchers at nonprofit universities and research institutes. TeselaGen reserves the right to terminate Free Accounts without notice. Accounts inactive for six months may result in file deletion without additional notice.

Secure Storage

Files are encrypted using AES-256 standard, the same encryption standard used by banks. We utilize Amazon Web Services (AWS) for cloud infrastructure and data storage across multiple data centers with military-grade physical security, video surveillance, and professional security staff meeting HIPAA standards. Protection includes defenses against DDoS attacks, MITM attacks, and packet sniffing.

Secure Transfers

Data transmission between desktop clients and servers uses 256-bit SSL (Secure Sockets Layer) encryption, the standard for secure Internet network connections.

Data Backups

TeselaGen and AWS maintain redundant backups across multiple locations to prevent data loss.

Privacy

Complete privacy policy details are available in our Privacy Policy. We restrict employee access to user data content; employees may only view metadata such as names and locations. Limited access occurs only per privacy policy requirements. Physical and electronic security measures protect information from unauthorized access.

Third-party Apps

Users accessing TeselaGen through third-party applications should review those apps' security protocols and privacy policies, as they may employ different encryption standards and data handling practices.

Compliance with Laws & Law Enforcement

TeselaGen cooperates with U.S. law enforcement when receiving valid legal process, removing encryption before providing file contents to authorities as required by law.

User-Applied Encryption

Users can encrypt files before uploading to manage their own encryption keys. Note: this disables certain features like public links and prevents TeselaGen recovery if the key is lost.

Security Reporting

Security concerns should be reported through our contact page. We credit contributors whose reports improve security.

Modifications

TeselaGen may revise these Terms at any time, with current versions posted on this website. Material revisions trigger notification via email or blog posts. Continued Service use after revisions become effective constitutes acceptance. If you disagree with new terms, you must discontinue Service use.
